Terms of sale
What you are buying, at what price, how you receive it, and how to get a refund if you change your mind.
About this translation. These terms were written in French. This English version is a translation provided for your convenience: if the two versions differ, the French version prevails.
Article 1. Seller
The AFE software is published and sold by MaiTox, a sole proprietor operating under the French micro-enterprise regime, established in France (hereinafter “the seller”).
Contact: contact@maitox.fr. Website: https://maitox.fr.
The seller’s name, address and SIRET registration number appear on the order confirmation and on the invoice sent to the customer.
Article 2. Purpose and acceptance
These terms of sale apply to every order for a licence of the AFE software placed with the seller, whether by a consumer or by a business customer (hereinafter “the customer”).
Placing an order means that the customer has read and accepted these terms. The applicable version is the one in force on the day of the order.
Article 3. The software
AFE is desktop software for Windows intended for freelancers: quotes, invoices, credit notes, payment tracking, a receipts book, and estimates of contributions and taxes. It works without an account and without a connection: the customer’s business data is stored on the customer’s device.
A free 14-day trial with every feature is offered with no commitment. The customer is invited to check during this trial that the software suits their needs, their country of taxation and their equipment.
Article 4. Options and prices
Three licence options are offered:
- monthly subscription: €7.90 per month;
- yearly subscription: €59 per year;
- perpetual licence: €79 in a single payment.
Launch offer. Until 31 December 2026 at midnight (Paris time), or until the fiftieth licence sold across all options if that happens before that date, the prices are as follows: €7.11 for the first month of a monthly subscription, €44 for the first year of a yearly subscription, €59 for the perpetual licence. For subscriptions, the launch price applies to the first period; the following periods are charged at the price then in force.
The applicable price is the one shown on the website on the day of the request, and restated in the order confirmation. Prices are in euros and are net: VAT not applicable, art. 293 B of the French General Tax Code (CGI).
The seller may change its prices at any time. A confirmed order, or a subscription period that has already been paid for, is not affected by a later change.
Article 5. Ordering
The customer sends a request using the form on the AFE page, stating the option chosen and the name to put on the licence.
The seller replies by email with an order confirmation that restates the option, the price and the payment details. The contract is concluded when the payment is received.
The seller may refuse an order for a legitimate reason, for example if there is an ongoing dispute with the customer.
Article 6. Payment
The price is payable in full, in a single payment, by the means of payment stated in the order confirmation. No bank details are requested or stored on the maitox.fr website.
An invoice is sent to the customer by email.
Article 7. Delivery of the licence key
The licence key is sent by email, to the address given by the customer, within two working days (48 working hours) of receipt of payment. The customer activates it in the software, in Settings, on the Licence tab.
If the key has not been received within that time, the customer reports it to contact@maitox.fr. If the key is not delivered within 14 days of payment, the customer may cancel the order and obtain a full refund of the sums paid.
Article 8. Licence to use
Payment gives the customer a personal, non-exclusive and non-transferable right to use AFE for the needs of their own business. The licence does not transfer any rights in the software.
The key is personal: it shows the customer’s name and email address in the software. It is not tied to any device, and the customer may use it on the devices they use themselves.
The customer must not share, publish, rent or resell the key, or circumvent the licence verification mechanism. The customer may decompile the software only in the cases provided for by law.
Perpetual licence
The perpetual licence is granted with no time limit. It covers every release of the major version current on the day of purchase, that is, those whose version number starts with the same first digit. A later major version may require the purchase of a new licence; the version acquired remains usable with no time limit.
Subscriptions
A subscription is taken out for the period paid for, one month or one year, starting when the key is sent. It gives access to every version released during that period.
A subscription is not renewed automatically. It is renewed by paying for the next period, at the price then in force, and a new key is then sent. Without renewal, it ends at the end of the period, with no charge and no formality.
At the end of the period, the customer’s documents remain readable, printable and exportable. Only the finalisation of new quotes and invoices is suspended until a valid licence is activated.
Article 9. Right of withdrawal
A customer who is a consumer has 14 days from the conclusion of the contract to withdraw, without having to give a reason.
To exercise this right, the customer sends the seller an unambiguous statement before the period expires, by email to contact@maitox.fr. The customer may use the model form reproduced at the end of these terms, but is not required to.
The seller refunds all sums paid no later than 14 days after being informed of the withdrawal, using the same means of payment as the one used for the order, unless the customer agrees to another means.
Withdrawal ends the licence: the customer stops using the key that was sent to them.
The right of withdrawal is reserved for consumers. It does not apply to purchases made by a business for the needs of its activity, except where the law provides otherwise.
Article 10. Statutory warranties
A customer who is a consumer benefits from the legal guarantee of conformity applicable to digital content and digital services (Articles L. 224-25-12 et seq. of the French Consumer Code) and from the warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code).
In the event of a lack of conformity, the customer is entitled to have the software brought into conformity, free of charge and without undue delay. If this is impossible or is not done within a reasonable time, the customer may obtain a price reduction, or termination of the contract with a refund.
For a perpetual licence, the seller is liable for any lack of conformity that appears within two years of the supply of the software. For a subscription, the seller is liable throughout its duration. During the period covered, the seller provides the updates needed to keep the software in conformity.
Any request under these warranties is sent to contact@maitox.fr.
Article 11. Liability
AFE is a tool that helps with business administration. The contribution, tax and threshold amounts it displays are estimates, calculated from rates that the customer can edit. They replace neither the official returns filed with the relevant authorities nor the advice of an accounting or legal professional.
The customer remains responsible for their returns, for the compliance of their quotes and invoices with the regulations of their country, and for backing up their data. That data is stored only on the customer’s device: the seller has no access to it and cannot restore it.
With regard to business customers, the seller’s liability is limited, for all losses combined, to the sums paid by the customer during the twelve months preceding the event giving rise to the claim. This limitation does not apply to consumers, whose statutory rights are not restricted by these terms, nor in the event of gross negligence or wilful misconduct.
Article 12. Personal data
The information sent with the order (name, email address, message) is used to process the request, issue the licence, draw up the invoice and follow up with the customer. Invoices are kept for the period required by law.
The software does not send any of the customer’s business data to the seller. On launch, it queries the service that hosts its updates to find out whether a new version exists.
The customer may exercise their rights of access, rectification and erasure by writing to contact@maitox.fr. The details are set out in the privacy policy (in French).
Article 13. Intellectual property
AFE, its code, its interface and its documentation remain the property of the seller. The documents the customer creates with the software, and the data the customer stores in it, belong to the customer.
Article 14. Complaints and mediation
Any complaint is sent in writing to contact@maitox.fr. The seller endeavours to reply as quickly as possible.
In accordance with Article L. 612-1 of the French Consumer Code, a customer who is a consumer and whose written complaint has not been resolved may use a consumer mediator free of charge. The seller provides the contact details of the competent mediator on request.
Article 15. Governing law
These terms are governed by French law. A consumer who resides in another Member State of the European Union retains the benefit of the mandatory provisions of the law of their country of residence.
Failing an amicable solution, the dispute is brought before the courts that have jurisdiction under the applicable legal rules.
Article 16. Model withdrawal form
Complete and return this form only if you wish to withdraw from the contract.
